Question

Do I change my marital status if I am common law now? How do I know if I am common law?

My partner and I were living together for one year as of October 15, 2022. Are we considered common law and why? Do I claim his son as a dependent if he lived with us half time?

Yes, if you'd been living together for a year as of October 15th, 2022, then you would be considered common-law.

As per CRA: Living common-law means that you are living in a conjugal relationship with a person who is not your married spouse, and at least one of the following conditions applies:

    • This person has been living with you in a conjugal relationship for at least 12 continuous months.

Yes, you can claim him as a dependent if he lived with you half-time.
