How do I find out if someone has used my dependent on their income taxes,

I am trying to e-file my federal return and it's not going thru, their is a problem with one of my dependents and I believe that my daughter has been claimed on someone else's income taxes. How do I find out who is it, and how do I get them for fraudulently claiming someone who is not their dependent.

You can't find out. But, here's what you do:

If someone else claimed your dependent child inappropriately, and if they file first, your return will be rejected if e-filed.You would then need to file a return on paper, claiming the child as  appropriate. The IRS will process your return and send you your refund, in the normal time. Shortly (up to a year) thereafter, you'll receive a letter from the IRS, stating that your child was claimed on another return. It will tell you that if you made a mistake to file an amended return and if you didn't make a mistake to do nothing. The other party will get the same letter you did. If one of you doesn't file an amended return, unclaiming the child, the next letter, from the IRS, will require you to provide proof. Be sure to reply in a timely manner.

Winner gets the tax benefits; loser gets to pay the IRS back with penalties and interest. The custodial parent almost always wins. The non-custodial parent can only claim the child as a dependent if the custodial parent gives permission (on form 8332) or if it's spelled out in a pre 2009 divorce decree. https://www.thebalance.com/claiming-same-dependent-audit-risk-3193030

3. Some other member of the household (e.g. grandparent)
4. Someone else the child lived with for part of the year

I don't file taxes i have gotten ssi for my hole life but they cut me of about 4to5 years now and I have no income  and I wanted to no y I didn't get my stimulus check no one should have claimed me im not sure if that is what happen but I haven't gotten my check so idk why can u help me

Did you get the first stimulus payment?  @Cristina11   As long as you qualify for the payments, you will receive them.  The same eligibility rules apply to the second stimulus payment as the first one. You must have a valid Social Security number, and you can’t have been claimed as a dependent on someone else’s 2019 tax return.

 

If you don’t receive the payments or the correct amount of stimulus payment, you can claim the Recovery Rebate Credit when you file your 2020 taxes and it will provide the same amount of payment as the stimulus would have. TurboTax will guide you through this to make sure you get every dollar you deserve.  You will be able to do this even if you don't have any income.  

 

We suggest that you save your IRS letter-Notice 1444 which is mailed after the IRS provides you with a stimulus payment. You can use that info when you file your 2020 return to make sure you’ve received the amount you deserve. If your stimulus payments weren’t correct, you may receive the funds as a credit which can add to your refund.

So I applied for the stimulus check I put my son on it but I only got the amount for myself not for him does that mean somebody claimed him and did not tell me how do I go about getting that person in trouble because I believe that is illegal I have sole custody of my son he is with me full-time

I efiled January 15th, and it got rejected ever since. <span;>Federal Reject Code R0000-902 I've been getting this code and I dont know why. No one else is supposed to claim me or my children

You will have to file your return by mail - once one of your dependent's SSNs is used on another return, the IRS will not accept an e-filed return from you. 

 

If someone else claimed your dependent already, then your e-filed return will be rejected.  Print, sign and mail your own return which claims your dependent.  

 

Mailed returns are processed differently by the IRS.  It will take some time (maybe even up to a year) but eventually the IRS will contact both parties and sort out who could rightfully claim the dependent.  The person who wrongfully claimed the dependent will face repayment of refund $, plus penalties.

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Hi I did my taxes through TurboTax and they told me My dependent on qualified because someone else claim **bleep** I need to know how can I stop there so I won’t happen next year did not authorize to use my daughter I have full custody and she lives with me

@Shakira1 You cannot find out.  The IRS will not tell you.   But if your return is being rejected because someone else claimed your child, you cannot e-file. You have to print sign and mail your own return and let the IRS sort it out.

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Federal and state returns must be in separate envelopes and they are mailed to different addresses.  Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.

Why the IRS not giving the person they tax refund when they claim a child? It been 2 months and they still not getting they refund?

It has not been two months... The IRS did not even begin to accept or process 2020 returns until February 12.  If you filed earlier then your return was just sitting on a server.

 

TurboTax gives you an estimated date for receiving your refund based on a 21 day average from your date of acceptance, but it can take longer.  Many refunds are taking longer during the pandemic. 

 

 

First, check your e-file status to see if your return was accepted:

 If accepted, they try to process it within three weeks but it can be longer.  if you have earned income credit or additional child tax credit, it will be at least the end of February before you see your refund, due to the PATH act that requires that they hold your refund longer.

 

Once your federal return has been accepted by the IRS, only the IRS has any control.  TurboTax does not receive any updates from the IRS. Your ONLY source of information about your refund now is the IRS.

You need your filing status, your Social Security number and the exact amount  (line 34of your 2020 Form 1040) of your federal refund to track your Federal refund:

@Bradford3 If you Efile your return and someone else has used your SSN, the IRS will reject your return and tell you that someone has used your Social Security Number on a return.

TurboTax does not have that information; you have to work with the IRS.

If you do not have a dependent, you do not need to claim.
