I am in a partnership and my other half claims the house. We took out a HELOC and my name is listed first and I am the one that got the 1098. How do I file

Yes, even if your name is not on Form 1098, you may be able to include Mortgage Interest reported on Form 1098 if: 

  • you are an owner of the property and 
  • you make the mortgage payments.
