Do you have to be divorced to get the dependent care credit? According to the turbo tax online site, if I don't live separate from my spouse I don't qualify

    You cannot get the childcare credit if you are filing married filing separately.    If you have lived apart from your spouse for at least the last six months of 2024 and you have had custody of the children you can file as Head of Household---that way you can get the best child related credits including the childcare credit.

     

    If you and your spouse are living together and just filing MFS, then sorry, you are not eligible to get the childcare credit.
