I am self employed but my spouse gets employer paid health insurance. Can I deduct the cost of my health insurance premiums I pay out of pocket?

Unfortunately, having access to insurance through your spouse's employer almost always disqualifies the Self Employed Health Insurance deduction.

I said "almost" always because in the extremely unlikely event the employer paid nothing for your spouse's insurance (your spouse pays 100% of the cost), then you could qualify for the Self Employed Health Insurance deduction.

Were you eligible to participate in the health insurance provided by your wife's employer?  In other words, could you have been covered under the health insurance plan provided by your wife's employer?

yes.  Prohibitively expensive, but available to spouses
