I'm on H1B Visa and treated as resident for tax purposes and my wife is on F1 and came to US in 2015 . Can i claim life time learning credit for the fees i paid for her?

Hi , I am on H1B Visa and treated as resident for tax purposes and my wife is on F1 and came to US in 2015 .I paid all my wife fee and  I am planning to file Married jointly. Can i claim life time learning credit for the fees i paid for her?

    Yes.  You can claim the Lifetime Learning Credit on any qualified education expenses you paid on your spouse.  According to IRS publication 970, since you are considered as a resident, when you make the choice Nonresident Spouse treated as resident, you both will be treated as residents and file Married Filing Jointly on your 2015 tax return.  You will be receiving the same tax treatment as every other US citizen or resident for the education benefits.  Please see attached.
