What if my child care provider doesn't claim her earnings on her tax refund?

My child care provider is a personal family friend. I pay her $125/week, 50 weeks out of the year. She does not claim her earnings from babysitting on her taxes, so am I still able to receive a tax break for it?

in order for you to claim the childcare credit, you must provide the care provider's Social Security number.  The provider is responsible for reporting the income and paying the resulting tax.
