Who can claim head of household with two families

my daughter and her family have lived with me for four years not paying anything,and  had a new baby since then she wants to claim head of household.. and I say I will, because I have paid everything, she even moved her boyfriend in my small  one bedroom..Can two people living same address claim head of houshold

    The simple answer to your question is No. Two people living in the same household cannot both claim Head of Household (HoH) filing status. 

    The longer answer is maybe. Although everything you described in both of your posts would not indicate that's possible in your circumstances. The rule is that you must have paid more than half the household expenses, and have a qualifying dependent. Usually, if you more than paid half, the other person must have paid less than half.

    If your situation closely matches the IRS "Acknowledged Significant Advice" at this link, you might qualify. http://www.unclefed.com/ForTaxProfs/irs-wd/1998/1998-041.pdf . It's a tough standard to meet and most living arrangements will not qualify. If she tries it, she should be prepared to prove it with detailed accounting records of household expenses.

    You can't claim Head of Household if you have not paid more than half the cost of keeping up a home.  If she has not paid anything, she cannot claim Head of Household. Also, 2 people in the same household usually cannot not have paid for more than half the cost of keeping of the home, so both cannot claim the Head of Household status.

    You may be able to file as Head of Household if you meet all the following requirements:

    - You are unmarried or “considered unmarried” on the last day of the year.

    - You paid more than half the cost of keeping up a home for the year

    - A “qualifying person” lived with you in the home for more than half the year (except for temporary absences, such as school). However, if the “qualifying person” is your dependent parent, he or she does not have to live with you.

    The person who qualified you for Head of Household must be a blood relative.
