As we all know on turbotax community, the question of whether small-time landlords need to issue 1099-NEC forms to contractors that are paid $600 or is still questionable. are there any current instructions for this?

    The IRS says you issue a 1099 to each person in the course of your business to whom you have paid $600 or more for services during the year.  There is no specific mention of rental properties being a business, which is the argument the "no" proponents use.  Now that it is easier to file the 1099s, it is quite easy to err on the side of caution and issue the 1099s.

    Thank you for your reply.  It sounds like the unsolvable question.  It is odd that the courts would be so vague on an issue.

    The issue could be the fact that some rentals owners are very professional with their rental enterprises while others are average people renting a room or home for spare income and some tax professionals argue that the average person should not be obligated to know business requirements.
