I claimed my disabled adult niece as dependent. I'm i eligible to receive child tax credit?

    If she was older than 16 in 2020 then she is not eligible for the child tax credit.  The child tax credit is based on age only.

    There is an exemption for a qualifying relative, but no tax credit available.  The child tax credit only applies to a child under 18 for the entire year.

    If you claimed your adult niece as a dependent you can get the $500 credit for other dependents, but not the child tax credit.   The CTC is not allowed for dependents who were over the age of 16 on a 2020 return or who will be over the age of 17 at the end of 2021 for the 2021 CTC.

    However, if you are able to claim her as a dependent, then you can get the 3rd EIP for claiming her as a dependent.  

     

     

    WHO CAN I CLAIM AS A DEPENDENT?

     

     

    You can claim a child, relative, friend, or fiancé (etc.) as a dependent on your 2020 taxes as long as they meet the following requirements:

    Qualifying child

    • They're related to you.
    • They aren't claimed as a dependent by someone else.
    • They're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
    • They aren’t filing a joint return with their spouse.
    • They're under the age of 19 (or 24 for full-time students).
      • No age limit for permanently and totally disabled children.
    • They lived with you for more than half the year (exceptions apply).
    • They didn't provide more than half of their own support for the year.

    Qualifying relative

    • They don't have to be related to you (despite the name).
    • They aren't claimed as a dependent by someone else.
    • They're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
    • They aren’t filing a joint return with their spouse.
    • They lived with you the entire year (exceptions apply).
    • They made less than $4,300 in 2020.
    • You provided more than half of their financial support.

    If the disable adult dependent has non-taxable benefits, those don't have to be entered, correct?  Only income they make that is taxable needs to be entered, correct?
