Tell us more.   How old were you at the end of 2020?  Were you a full-time student in 2020?  Did you have over $4300 of income in 2020?  Who supported you and your child?

 

There are two kinds of dependents.  Do you meet the criteria for your mom to claim you as a qualifying child or qualifying relative?

 

 

WHO CAN I CLAIM AS A DEPENDENT?

 

You can claim a child, relative, friend, fiance (etc.) as a dependent on your 2019 taxes as long as they meet the following requirements:

Qualifying child

• They are related to you.

• They cannot be claimed as a dependent by someone else.

• They are a U.S. citizen, resident alien, national, or a Canadian or   Mexican resident.

• They are not filing a joint return with their spouse.

• They are under the age of 19 (or 24 for full-time students).

    • No age limit for permanently and totally disabled children

        They live with you for more than half the year (exceptions apply).

Qualifying relative

• They don't have to be related to you (despite the name).

• They cannot be claimed as a dependent by someone else.

• They are a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.

• They are not filing a joint return with their spouse.

They lived with you the entire year.

• They made less than $4300  (not counting Social Security)

• You provided more than half of their financial support. More info

I was 19 back in 2019. I ended 2020 being 20. I also was enrolled part time during spring of 2020, and worked all 2020. I’m not sure how much I’ve made so far. I just had my baby in October but it’s been me supporting myself and her.

Your mom was probably right to claim you in 2019, but maybe not. But, you can still get all the stimulus on your 2020 tax return. Be sure to tell your mom not to claim you for 2020. 

 

Under the CARES Act, if you are claimed, or qualify to be claimed, as a dependent on someone else’s return you cannot receive a stimulus check, in 2020.   If you qualified as a dependent for 2019, but will not be for 2020, you will  get it in 2021, when you file a 2020 tax return.

When you file your 2020 income tax return, you will be asked for information about the amount of the stimulus payment you received, and if it is less than you are entitled to, you will be given a credit on your 2020 tax return.

"In essence, the stimulus check acts as an advance of your 2020 income tax refund. This means when you prepare your 2020 income tax return, there will be a line to include the section 6428 credit (line 30 on the 2020 form 1040). The credit on your 2020 return is subtracted by any amount received as a stimulus check in 2020. If the amount you received as a stimulus check is less than the credit you are due, the difference will be included as part of your 2020 refund. If you have been overpaid by receiving the stimulus check, however, you will not be required to return any excess amount".
