Is my mother a dependent

My mother lives in memory care.  I financially provide 1/3 of her support.   Can I claim her as a dependent.  She receives a 1099 R from an annuity based on my deceased fathers retirement and VA benefits also through my deceased father.

    Generally no because you did not provide more than half of her financial support.  Please see the other requirements to be a dependent:

     

     Qualifying relative

    • They don't have to be related to you (despite the name).
    • They aren't claimed as a dependent by someone else.
    • They're a U.S. citizen, resident alien, national, or a Canadian or Mexican resident.
    • They aren’t filing a joint return with their spouse.
    • They lived with you the entire year (parents do not have to live with you).
    • They made less than $4,200 in 2019.
    • You provided more than half of their financial support.
