Do I need to file NJ state return? Married couple, both retired, no wages, only 1099INT and 1099DIV, no draws on pension. No income taxes withheld, no taxes due. Based on Turbo tax calculations we owe nothing.
It depends.
If you are a resident of NJ, according to the NJ department of revenue, you are required to file an NJ resident state income tax return if:
- your filing status is married filing jointly and your gross income from everywhere for the entire year was more than the filing threshold of $20,000. (single/married filing separately - $10,000)
Additionally, you must file a return to receive your refund or credit even if your income is equal to or below the filing threshold if:
- You had New Jersey income tax withheld and are due a refund.
- You paid New Jersey estimated taxes and are due a refund.
- You are eligible for a New Jersey earned income tax credit or other credit and are due a refund.
If you do not meet these NJ filing requirements, you have no NJ state income tax filing.
