Question

My tax dependent (18 in college) started a business (sole proprietorship) in 2022 - how do we go about filing taxes?

Normally I file as HoH.  He actually had a loss in his first year.

You can still file as HOH if he meets the qualifications for a dependent.  To qualify as a dependent, he must be:

  1. under age 19 or, if a full-time student, under age 24. There's no age limit if your child is permanently disabled.
  2. must live with you for more than half the year, but several exceptions apply.
  3. He may have a job but cannot provide more than half of their support.

If he qualifies as a dependent and you claim him on your return, he must file his return indicating he is claimed on someone else's return.  He cannot file his return and claim himself.
