Hi, I was a TN visa holder until June 21, 2024. I filed taxes from 2021-2023 fiscal years. Is my understanding I met the requirement for the 183 days (substantial presence days) but I just want to be sure I understood the rule correctly. Also, if I need to file taxes for 2024, could I do so using TurboTax?

    Yes, if you met the substantial presence test, you would be considered a Resident Alien and would need to file a form 1040. Since you were here until June 21, 2024, if you had taxable income in 2024, yes, you would still need to file a return for 2024 and could use TurboTax to do so.  

     

    Unless otherwise chosen, your tax residency end date is December 31, 2024.  You may be able to elect to have the status changed on the last day of your presence in the US.  Please see Page 12 of pub 519 for further details
