I live in Maryland and won $900 in Virginia casino. They took federal and state tax out. Do I have to claim the winnings in both Virginia and Maryland? Do I have to buy the Virginia state tax form on Turbo Tax just to claim the gambling winnings?

    Yes you would have to file a Virginia tax return to get the withholding refunded.  You would also have to report the income on your Maryland resident tax return.  (It should not be taxed in Virginia so there will be no credit for taxes paid to another jurisdiction for Maryland).

    Thank you. If TurboTax comes with one free state download, will I have to download the Virginia one just to get my $49 tax withheld in Virginia? It will probably cost more than that to download the Virginia state. Any way around that?

    The amount of your winnings is under the required amounts for Virginia, so you aren't required to file a return.  You might want to file to get the withholding that was taken out, but as you mentioned, it might not be worth it if the fee is higher than the amount you had withheld.  

     

    Per the Virginia Department of Taxation:

     

    You must file a return if:

     

    • you are a resident of Virginia, part-year resident, or a nonresident, and
    • you are required to file a federal income tax return, and
    • you have Virginia adjusted gross income equal to or greater than the amounts below: 
       

    Single or married filing separately $11,950

    Married filing jointly $23,900
