Question

I sold a home in California and I live in Oklahoma. Am I subject to California tax withholding?

My wife inherited a home in California in 2021.  Moved to Oklahoma that same year.  Sold the home in 2025.  Aside from capital gain from appreciation from 2021 to 2025 is she subject to California withholding and California taxes?  We have not filed a California State Return since tax year 2021.

If you mean withholding on the sale of the home, yes, you need to file Form 593 and submit California withholding for the sale.

Yes, you will need to file a non-resident California return and also a resident Oklahoma return. Please do the California return first in case a credit for the tax paid to California needs to be computed on the Oklahoma return.
