KY RESIDENT, VA WORK

I am a KY resident and work in several states. One of the states I work in is VA. My employer withheld tax from both KY and VA. So basically I’m being taxed in both states. My question is do I file 763 or 763S? What’s the difference? They seem to be both non resident forms?

Because Virginia and Kentucky have a reciprocal agreement, you can report and pay the tax in your resident state Kentucky.  In this case, you can file the 763S which is a request for the withholding.  The 763 is the actual nonresident tax return, on which you would report zero Virginia income and get the refund.  You can complete the 763S without having to pay for an additional tax prep fee.
