New York City Part Time Resident

Hi all,

 

I lived in New York City from January 1, 2024 to August 4, 2024, then I moved out of state and stopped earning any income from NYC or New York State after that date.

 

In TurboTax, I selected that I was a part-year resident of New York State, and indicated the correct move-out date. But when I get to the NYC section, it’s taxing me based on my entire year’s income, not just the portion I earned while living there.

 

Why is that happening?

 

Shouldn’t I be considered a nonresident of NYC since I moved away before the end of the year and didn’t return? I’ve read that NYC doesn’t allow part-year residency — so I’m confused why it’s still taxing me.

 

Any help is appreciated!

New York counts you as a full year resident if you live there for at least 184 days in the year.  Which you did.  So for New York purposes you are a full year resident.

 

On the upside you can take a credit for the taxes paid to New York on any income that is also taxed by your new state.  Just do the New York return first and then when you do your new state you can take a credit for the taxes paid on the income that was also taxed by New York.
