I am a military spouse. My husband residency is Florida. I am a resident of Virginia and I work in Virginia. How do I file my Virginia state taxes?

    If you are not covered under MSRRA and your state of residence is VA (while your spouse's state of residence is FL), then you would still be able to file your federal income taxes jointly but you would need to file your state income taxes as married filing separately. Your husband will not have a state income tax filing if all of his military income is from active military duty because FL has no individual state income tax.
