Question

I am active duty military stationed in South Korea. I am a nonresident for 2023. TurboTax is asking me to input state and zip code. Also, it still says resident on home.

Hi. I am a non resident for my NY tax return. I filed a IT 203 before. I’ve been stationed in South Korea for a few years. TurboTax is asking me to input my state and zip code. I have already put in the foreign zip code but it still gives me an error. Additionally, when I go to homepage, it still says that the NY resident is resident. When I click into it, it says that they recommend non resident and I select that as well.

It depends on what your Home of Record state was when you originally enlisted.  If it was NY, then this is your resident state for tax reporting purposes even though you haven't lived there for several years.

Well...if stationed out of NY all of 2023, then NY lets you file "AS-IF" you were a nonresident...thus not taxing military income.

 

Not sure exactly how it works in the software

BUT

1)  Make sure you enter that you were a NY resident when you enter your Personal Info about yourself.

2) As a part of #1, the Q&A will ask if you were in the military in 2023.

3) Your mailing address is immaterial to this and should be where you get mail.

4)  When you enter your Military W-2, after the main form, there is a follow-up page with a bunch of checkboxes.  Make sure you check the one to indicate it is a Military W-2.  (Civilians work for DFAS too, so a W-2 form DFAS doesn't mean it's an active duty military W-2).

 

Somewhere along the line...either in the part above...or when you start the NY section, NY will ask if you were stationed in NY during 2023...you will indicate you were not...and that should trigger the NY-nonresident form.

@rjs ,  @maglib    Yall, work specifically with NY.  Do y'all know for sure how-when the Military person with HOR-NY indicates they were stationed out of state in the software to trigger the nonresident NY forms?

"I am a nonresident for 2023"  what do you mean by this?  Prior to enlisting, what was you state of residency?  Did you create any change of address after listing like most military do?
