Non-military spouse from MD lives and works in Nevada where we are stationed. Military member files MD state taxes. Can the non-military spouse choose to not file MD tax?

Yes.

 

As long as the spouse is domiciled in another state, they can elect to not be taxed in Maryland as long as they are not earning any income within Maryland.
